MARRIAGE FOR FOREIGNERS IN THE DOMINICAN REPUBLIC




REQUIREMENTS FOR A FOREIGNER TO BE ABLE TO MARRY IN THE DOMINICAN REPUBLIC:


1- Birth certificate apostilled by the authorities of the country that issued it.


NOTE: In the unlikely event that the country that issued the birth certificate, form no part of the Hague Convention, the certificate must be legalized by the Dominican Consul in that country; otherwise, request an authorization to marry, to the Civil Directorate, Central Electoral Board.


2- In the event that the birth certificate is in a foreign language, the birth certificate must be translated by a court interpreter; and legalize it in the Office of the Attorney General of the Republic.


3- Copy of passport.


4- Certification of single status, carried out by a Notary Public.


5- Two witnesses (godparents), who are not relatives of the future spouses.


6- If the foreigner is divorced, he must have the divorce certificate.


NOTES: 1- The documents have to be deposited before the corresponding Civil Registry Office, a few days before the wedding.


2- The civil marriage must be celebrated publicly, before a Civil Status Officer.


MARRIAGE WITH SEPARATION OF ASSETS.


If marriage is to be carried out under the regime of separation of property, must be done by before a notary public, an authentic act signed by the couple and two witnesses, recording the act by the Registry, to be notified and the Certified legalized by the Attorney General of the Republic.

MATRIMONIO PARA EXTRANJEROS EN REPÚBLICA DOMINICANA:



REQUISITOS PARA UN EXTRANJERO PODER CONTRAER MATRIMONIO EN REPÚBLICA DOMINICANA:

1- Certificado de nacimiento apostillada por las autoridades del país que la expidió.

NOTA: En el hipotético caso de que el país que emitió el acta de nacimiento, no forme parte del Convenio de la Haya, dicha acta debe de estar legalizada por el Cónsul dominicano de ése país; de lo contrario, solicitar una autorización para contraer matrimonio, a la Dirección Civil, Junta Central Electoral.

2- En caso de que el acta de nacimiento éste en un idioma extranjero, hay que realizar la traducción del acta de nacimiento, por un intérprete judicial; y legalizar la misma en la Procuraduría General de la República.

3- Copia del pasaporte.

4- Certificación de soltería, realizada por ante un Notario Público.

5- Dos testigos (padrinos), que no sean familiar de los futuros esposos.

6- Si el extranjero es divorciado, debe tener el certificado de divorcio.

NOTAS: 1- Los documentos tienen que depositarse por ante La Oficialía del Estado Civil correspondientes, algunos días antes de la boda.

2- El matrimonio civil, debe celebrarse de manera pública, por ante un Oficial del Estado Civil.

MATRIMONIO CON SEPARACIÓN DE BIENES.

Si el matrimonio se va a llevar a cabo, bajo el régimen de separación de bienes, debe de realizarse por ante un Notario Público, un acto auténtico firmado por la pareja y dos testigos, registrar dicho acto por el Registro Civil, ser notificado y la compulsa legalizada en la Procuraduría General de la República.

THERE ARE TWO TYPES OF DIVORCE AVAILABLE TO FOREIGNERS IN THE DOMINICAN REPUBLIC, TO KNOW:

1) Divorce by mutual consent, and 2) Divorce for other determined reasons.

The majority of Dominican divorces granted to foreigners are divorces by mutual consent.

In these divorces, the plaintiff does not need to prove a specific cause to dissolve the marriage bond, on the contrary, he must prove mutual agreement to dissolve the marriage.

Although residency is not a requirement, at least one of the parties must be present at the hearing. The other party may be represented by a lawyer authorized by a power of attorney duly deposited in the Civil Registry office.

A foreigner can obtain a divorce for cause (example, incompatibility of characters, adultery, etc.) if he or she resided in the Dominican Republic and the cause of the action or reason for the divorce was presented during the period of residence.

Divorce for cause requires the appearance in person of the defendant or his legal representative. In a divorce for cause, the judge has extensive power, including the power to determine the disposition of marital property and support payments, if necessary, for the wife and children.

A divorce in the Dominican Republic, either by mutual consent or by cause, has no effect or validity until a certain period of time elapses since some specific steps are taken during the final phase of the process.

The sentence must be issued and filed in the corresponding Civil Registry office. This filing date is the beginning of the 60-day period during which either party can appeal the judge's decision.

The next step is to make the pronouncement of the divorce sentence by a Civil Registry Officer. The pronouncement ends the marriage. The parties are then considered single.

Within eight days after the divorce is pronounced, it must be published once in a newspaper of general circulation. Without the pronouncement and publication of the divorce, it is invalid under Dominican law.
